WhatleyKallas Attends DOJ Workshop On Most Favored Nations Clauses

TuckerOn September 10th, WhatleyKallas partner Tucker Brown participated in  the U.S. Department of Justice (DOJ) and the Federal Trade Commission (FTC) workshop on Most-Favored-Nation (MFN) Clauses and Antitrust Enforcement and Policy at the FTC’s satellite offices in Washington, D.C. The workshop featured speakers and panel discussions including DOJ and FTC officials, antitrust attorneys, healthcare industry leaders, and influential economists, related to the recent enforcement actions by the DOJ and FTC, in particular the DOJ’s recent action against Blue Cross and Blue Shield of Michigan.  It was apparent from the workshop that federal regulators are becoming increasingly interested in and skeptical of Most Favored Nation clauses, particularly in the healthcare industry.  WhatleyKallas will continue to closely monitor developments in this fast moving intersection of healthcare and antitrust law.
