FIFTH CIRCUIT STAYS PROCEEDINGS IN CASE OVER THE CONSTITUTIONALITY OF THE AFFORDABLE CARE ACT

            In “light of the lapse of appropriations” due to the partial government shutdown, on January 11, 2019, the Fifth Circuit Court of Appeals stayed proceedings in the appeal of a District Court’s decision finding the Affordable Care Act unconstitutional. The District Court’s decision finding the ACA unconstitutional has likewise been stayed pending appeal. The case, and the ultimate fate of the ACA, is likely to be decided by the United States Supreme Court.
