WHATLEY KALLAS FILES SUPREME COURT BRIEFS ON COVID RESTRICTIONS

 

Whatley Kallas LLP has filed briefs in support of New York Governor Andrew M. Cuomo in two Supreme Court cases involving the State of New York’s response to COVID-19. The State imposed heightened restrictions in area where the prevalence of COVID-19 is especially high. Among those restrictions were that houses of worship could not accommodate more than ten people at a time in “red zones,” or twenty-five people in “orange zones.”  The Roman Catholic Diocese of Brooklyn and Agudath Israel of America sought emergency injunctive relief, which the Eastern District of New York and the Second Circuit denied. They then filed emergency applications for an injunction from the Supreme Court. Whatley Kallas filed an amicus brief on behalf of the American Medical Association and the Medical Society of the State of New York, explaining the science behind the transmission of the novel coronavirus and the particular risk associated with religious services.
