HHS Releases Three Important ACA Regulations

The Department of Health and Human Services today released three proposed rules and a notice that will help implement the Affordable Care Act, including proposed rules on essential health benefits and pre-existing conditions.

HHS released three proposed rules, which will be published in the upcoming Federal Register:

  • a “rate review” rule (CMS-9972-P) related to “fair health insurance premiums, guaranteed availability, guaranteed renewability, risk pools, and catastrophic plans”;

  •  a rule on wellness programs (CMS-9979-P); and

  • a rule on essential health benefits coverage (CMS-9980-P).

Further, HHS released a notice that recognizes the National Committee for Quality Assurance and URAC as accrediting entities for the purposes of fulfilling the accreditation requirement as part of qualified health plan certification (CMS-9961-N).
