UNITED STATES SUPREME COURT PERMITS AFFORDABLE CARE ACT SUBSIDIES NATIONWIDE

This morning, in a 6-3 decision, the United States Supreme Court ruled that the health care subsidies for certain low and middle class people could be provided nationwide. In the majority opinion drafted by Chief Justice Roberts, the Court found that the Affordable Care Act subsidies were not limited only to states that provided their own exchanges, ruling against 4 Virginia residents who had filed suit on the basis.  The ruling affects about 85% of those purchasing insurance on the Affordable Care Act health insurance exchanges.  The decision is attached here.  Whatley Kallas is continuing to review the decision and will continue to work in this quickly evolving area of law.
