Blue Cross Antitrust Litigation
Joe Whatley and Edith Kallas are co-lead counsel for the Provider Plaintiffs in the In re Blue Cross Blue Shield Antitrust Litigation MDL pending in the Northern District of Alabama. The Provider Plaintiffs (including hospitals, physicians, surgery centers, chiropractors, and other healthcare providers) allege that the Blues reached explicit agreement to divide the United States into "Service Areas" and then to allocate those geographic markets among themselves, free of competition among themselves. Further, the Provider Plaintiffs challenge the agreements reached by the Blues to fix prices for services rendered by healthcare providers through the Blue Card Program. Since the beginning of the litigation in 2012, Provider Plaintiffs have, among other things, survived multiple motions to dismiss and earned a favorable ruling regarding the standard of antitrust review. Whatley Kallas remains dedicated to obtaining meaningful relief for all healthcare providers from the Blues' unlawful conduct.
