LOVE V. BLUE CROSS BLUE SHIELD ASSOCIATION

Our lawyers served as Co-Lead Counsel and were the principal litigators and negotiators in this action representing a proposed class of physicians and medical associations against the vast majority of Blue Cross entities in the country.  The action alleged that these entities engaged in a RICO conspiracy to fraudulently underpay doctors through the use of automated claims processing software programmed to wrongfully reduce payments for services provided to enrollees in the defendants’ health care plans. Settlements were reached with approximately ninety percent (90%) of the defendants. The settlements provided for in excess of $130 million of monetary benefits and practice change relief valued in excess of two billion dollars.
